Asylum

Individuals arriving to the United States may seek protection due to experiences of persecution or the fear of potential persecution based on:

Race
Religion
Nationality
Membership in a particular social group
Political opinion

This application is only available to those currently in the U.S. who aren’t U.S. citizens. If you qualify for asylum, you might be allowed to stay in the U.S. while your application is being processed. To formally request asylum, either affirmatively or defensively, you need to file a Form I-589, Application for Asylum and for Withholding of Removal, within 1 year of your arrival to the United States. There’s no fee for this application.

You can list your spouse and children who are in the U.S. as dependents when you submit your application or any time before a final decision is reached. For a child to be considered a dependent, they must be under 21 and not married.
